What this is for
People upload music to 3GN Cloud. If something here is yours and should not be, this page is how you say so, and what happens next.
Sending a notice
Write to dmca@3gncloud.com. To be acted on, a notice has to contain all six of the following:
- Your physical or electronic signature, as the owner of the right or somebody authorised to act for them.
- What work you say has been infringed. If several, a list of them.
- What on this site you want removed, described well enough for us to find it — a link to the track, the post or the battle entry.
- How to reach you: an address, a telephone number and an email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the owner or authorised to act for them.
What we do with it
A complete notice gets the material taken down or disabled promptly. We tell the person who posted it what was removed and why, send them a copy of the notice, and explain that they can reply with a counter-notice.
Sending a counter-notice
If your upload was removed and you believe that was a mistake or a misidentification, write to dmca@3gncloud.com with all of the following:
- Your physical or electronic signature.
- What was removed and where it was before it was removed.
- A statement under penalty of perjury that you believe in good faith it was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the federal court for the district where you live — or, if you are outside the United States, of any district where we may be found — and that you will accept service from the person who sent the notice.
What happens then
We pass the counter-notice to whoever sent the original notice. If they do not tell us within ten to fourteen business days that they have gone to court to stop you, the material may be restored.
Getting it wrong on purpose
Knowingly claiming that material infringes when it does not — or that it was removed by mistake when it was not — carries liability for damages under section 512(f). Both directions. Do not file either one lightly.
Repeat infringers
Accounts that are the subject of repeated, valid notices are closed, and the uploads on them go with the account.
